Our Approach

At our first meeting, we will review your circumstances, provide you with a packet of information and give you a worksheet to complete. We will also provide you with a written estimate of our fees, so that you have a clear understanding of the potential costs.

When you have completed the worksheet, you will meet with one of our experienced paralegals to review the information. You will then meet with one of our attorneys, who will help you decide whether to file under Chapter 7 or Chapter 13. Under the new bankruptcy laws enacted in 2005, you must now qualify to file under Chapter 7 by submitting to a "means test." Our attorneys will review all the factors that are considered by the court when conducting the means test, so that you have a good sense of whether you will qualify.

Once you have made your decision, your bankruptcy petition will be filed electronically and a hearing will be scheduled in Pueblo, generally in 5 to 7 weeks. You will not be left to wonder about the proceedings you may be facing; we will advise you every step of the way.

Our Practice

Our attorneys handle all aspects of Chapter 7 and Chapter 13 bankruptcy filings.

Under Chapter 7, you may discharge certain debts in exchange for the sale or liquidation of assets. We will make certain that you understand what obligations cannot be extinguished before you file and will also ensure that you protect assets that may be exempt from sale, including your home, your car and your retirement assets.

In a Chapter 13 bankruptcy, known as reorganization, you agree to repay your creditors over a period of time, customarily three to five years. Priority taxes can also be included in your Chapter 13.

At our office, we will prepare all the necessary paperwork to file and process your personal bankruptcy. We will meet with the bankruptcy trustee to ensure that exempt assets are protected and we will appear on your behalf in any bankruptcy hearings.
